Read More - Quiet Titles A quiet title action deals directly with the ownership status of real property. A lawsuit which aims to "quiet title to property" is attempting to establish a party’s ownership or right to title under the law. In essence, a plaintiff is "quieting" disputes from defendants who claim an ownership right or interest in a specific property or portion of a property. Quiet title actions arise under myriad of circumstances, including defects with recorded documents, errors in the description of the property, and adverse possession claims. If a party bringing a quiet title action prevails, the prevailing party’s interest in the property becomes certified by the court and essentially eliminates other countervailing claims.
